    Had an accident, heres the evidence, tell me if I am in the right or wrong

    Ok, I had an accident at 12:30 today.

    A truck went into the driver side of me, turned into my lane without indicating, I braked but he completely scraped the side of me.

    I am unharmed, I'm not going to sue for whiplash and all that rollox. I want my car fix and my NCB intact.

    Here is the route taken around the roundabout first, I want to turn right onto the A road. So this is the route I took, the truck is moving starting at the blue point where I have met him. My route is green. Red is the point of collision.

    Firstly anything wrong with the route I have taken?

    Here is the damage to the car






    Most importantly there are tyre marks on the ground where I have had to avoid the truck and the tread matches my cars tread. I also have abrasion on the tyre wall. These show the exact point of impact. I'm not after all going to be driving so close to the pavement. (Green is point of impact,bit of paper as reference also)

    Now if I am at all wrong I will put my hands up and front the bill rather than going through insurance. I am pretty sure I have done nothing wrong here and the truck driver hasn't seen me. I didn't want to argue at the side of the road and he had a passenger with him who is obviously going to side with him.

    I have no witness other than this evidence.


    Is it my fault or Truck Drivers Fault?

    Looks to me like he got the wrong lane. The middle lane that he exited the roundabout is for turning going further around to the next exit.....

    Got the wrong lane, didnt look and exited the roundabout into you.

    it seems that he would be in the wrong for quite literally cutting you up, there appears to be 2 lanes going off the roundabout at the exit you took,

    you were in the left lane and took the left exit lane
    he was in the right lane and took the left exit lane when he could have stayed in lane to exit safely

    Really sorry to hear of this bad news, how are you going to go about getting it sorted? do you contact the company he was driving for?

    I assume you got all his details. fair play on getting as much evidence as you did!

    Although saying that the exit is two laned and therefore he could exit from the middle lane of 3....(3rd lane for going further around) off the roundabout but probably just didnt follow the lines around the clipped you on the inside. Pic 6 shows its not a straight exit.

    You took the correct route, also he can't use his passenger as a witness.

    By the look of it he was in the wrong lane, he could have gone stright on in the lane but in the exit he should have been in the right hand lane, not cutting accross to your lane. so i think he was in the wrong,

    Were there any ohter cars behind / infront of you?

    I havent contacted the company, ive contacted my insurerers who need to send an assesor to see if the car is a write off!

    I got all his details. He was unwilling to give his home address.

    In fact on the internet there is a picture of him and the company he works for.

    There were no cars in front, could have been behind but I didnt see, I was trying to prevent really bad damage to my car!

    Good about his passenger as witness thats a relief.

    He doesnt have any other witnesses then.
