    Stepson taken from school by his dad now we cant get him back

    Had a phone call earlier from my wife to be to say that Jack was taken from school today at 2pm by his dad for no reason and now hes refusing to give him back. The thing is that Jack decided recently decided that he no longer wants to see his dad and is really scared of him and his horrible ways. we tried to call him to explain this but he wouldnt answer so a text had to do. we havnt heard from him for nearly 2 weeks and then he goes and does this. My g/f went to his mothers to try and get him back earlier but they just abused her and threw her off the garden. We called the police earlier and they said theres nothing they can do. they will go and see them and ask to give him back but they cant physically make him even thought they have both been drinking all day. We promised jack that we wouldnt let his dad take him unless it was ok with him so his head must be in bits. i cant imagine what hes feeling like. the police said that even if he doesnt want to be there they still cant take him. what would happen if this went to court and Jack actually said that he no longer wants to see him. would they still make him go?

    Sorry for the story just need a bit of advice on where we stand. any help would be greatly appreciated

    Can you call the NSPCC?

    If hes abusive/scared/ or drunk surely he is unable to look after a child?

    O if he is abusive to the child then surely the police have to step in?

    How old is he? (jack)

    Hi mate, may be able to offer some advice, but need to know more details, how old is Jack?
    has there been any Police intervention before?
    who from the Police have you spoken with??
    Why doesn't Jack want to see his dad?

    I know these are personal and as such if you want to PM me it might be better.

    I'm not 100% but if you go to court and are awarded primary custody of Jack i do believe he then has to give him back. A friend of mine had the exact same thing happen to her and had to go through the courts, she got her children back but sadly after several months in court.

    sounds like court the best way imo may take a while but sounds like they would defo side with yourself,not much help but good luck!!!

    hi buddy, sorry to hear of the situation.
    Firstly, were the school informed that Jack should not leave with his dad?
    Secondly, the court. From the age of 10, a child can express a wish as to which parent they would want to live with, but with a history of alcoholism and violence visitation rights could be granted but supervised (then the supervisor has the right/power to allow him to see Jack, ie. the dad is not pi$$ed up).
    Also are there any logs of violence and alcoholism (medical/police) as these would swing into your favour.

    Right now, do you believe there to be a child protection issue? If so, ring the NSPCC and social services, explain the situation and they should be able to remove him back into your custody. Needless to say that if this happens and you go to court, then there will be a record of the removal of Jack and once again go in your favour.

    I hope everything gets sorted out quickly. I understand how tricky situations like this can be.
    The easiest thing to do is ring the police and badger them they will do something even if its just mediating for a temporary solution.

    With court cases etc you always have to think about the kid involved. its easy to get carried away with your own feelings towards the other party.

    hope you get the results you two are looking for and Jack gets home soon
