    Please Help.... Scam

    Hello

    I ordered a phone on ebay, and it is a 100% fake, copy...

    It was the N95 8GB, i paid £259.99 for it (Buy it now option)

    The guy had 100% feedback (53 people give him this feedback...)

    Paid Via paypal...

    Whats my next step...

    I have contacted both ebay and the seller, and i am waiting on a reply...


    Gutted that i paid £259.99 for a fake phone that does not even come with a UK charger (The charger with it has 2 pins in it)

    How did you pay for it? Open a Paypal dispute if it was through them

    Whats fake about the phone, looks like a N95 but has its own software + hardware?

    as buckle said open a paypal dispute and get the money chargebacked to your account.

    had a friend who bought a £500 watch that was supposed to be real, turned out to be fake and only got a small amount back thru paypal due to the seller not having the correct amount of liability cover

    Its way to light to be real... i used to have one before but i sold it... and i missed it, so i bought another one..

    The buttons are also a reazlly really bad copy and it is just over all a really bad copy....

    ask the seller first but i'd phone nokia and ask them to check imei number etc to make sure its genuine??
    build quality can and does change with any product. (as an astra owner we all know that! lol) so would be worth making sure

    Your only real avenues are:

    1. Contact the seller an hope he does the right thing but if he's selling fakes then it's unlikely he'll go down that route.

    2. Conatct paypal , who will no doubt get you to send the item abck at your expense and maybe/maybe not get you a refund/partial refund if he has any money or offer to a reduced amount and you keep the phone but then again no guarantee.

    On that aspect I'm chasing an seller in China for a duff head unit and sent it back and provided paypal with the tracking number as requested. 3 weeks later they then asked me to provide a copy of the tracking slip which by this point I have binned as I'd already provided the the tracking info as they requested. The claim has now been passed back and forth as I have to keep explaining I've already gave the tracking number and no longer have the receipt. I very much doubt I will get a refund now but if anything I've learned keep all mails and receipts untill the pennies are back in your bank.

    Worst case scenario, you send it back you could end up with nowt , I know I sound synical but paypal won't always see you right so just work out whats best option for you, maybe damage limitation shit as it is as you paid honest money for an honest product.

    I really need to get out of working nights!!

    Second to that, if he has sent you an item that is not:NOKIA N95 8GB BLACK BUILD IN SATNAV BRAND NEW UNLOCKED'


    then he/she has commited a criminal offence. It's fraud.
    Contact Paypal, phone them if you have to ( 08707 307 191 )

    Secondly, it's more than likely this is knock-off goods. If it's being sold with the 2-pin continental plug, it's come off the back of a lorry - fraud squad could be interested. Give them a call, too ( 020 7239 7000/7190)

    Might be worth contacting the seller and telling them you're planning on doing this - might shake them into action.

    This is a good step to take. You said it has a none uk charger? sometimes the quality of items from other countries are not the same as the uk spec. Its an easy but long winded thing to sort but ebay and paypal do have ' Buyer Protection ' so you will get it sorted
