    Worst day ever....

Found a ford garage to rent a van from this morning so sent my bf off to get it sorted, he gets to the garage and it goes along the lines of:

BF - "hi id like to rent a van"

Ford Woman - "no problem sir have you got both parts of your license with you"

"no sorry i only have the card part with me"

"ok no problem i need to ring the dvla to check for endorsements etc"

"yes fine i have 6 points but thats all"

    DVLA:

Some Guy - "hi can i take your name and address etc.."

BF - "passed all the details over"

"ok sir i just need to check one detail ill just place you on hold"

"(female returns to phone) Hello sir, you have 6 points on your license so this license has now been revoked"

    "excuse me!!!"

"you had an accident in feb 07 and subsequently received 6 points in Sept 07"

"yes the points i got were in sept"

"Well because the accident was within your first 2 years the license has been revoked"

"It was 2 months till i hit the 2 year part and i didnt get the points untill september"

"sorry please return both parts of your license to us"
    Phone goes dead...

Can this stand up?? he has had NO notification from the DVLA, the Court anything at all, He recently had the police round as his car isnt taxed and they asked him to move it as it was technically classed as "on road" so now moved to "Off Road" but even they didnt say anything and would of thought it would of come up when they checked his details to get his name and address etc....

He is now talking about seeing a solicitor as when he had the initial accident there was NO witness, nobody else involved. He had the accident quite close to a cyclist who saw it and then decided to ring the police who came and had a look checked the details etc... The accident itself involved the car and a large fence/hedge and a very tight bend. There was no proof it was Careless driving as the copper didnt asses the road he just took a statement and left after having the car towed. Would he have any chance by seeing a solicitor???

    sorry i know its long..

Yep, DVLA can revolk your licence at any time. I'm betting there's a brown envelope somewhere with the bad news in i.t

I have heard of this before and zs is correct there is probably a brown envelope sitting in some mail office somewhere. They can revoke your licence unfortunatly for more than just points, for instance if you have a clean licence and then get caught speeding and don't send your licence away to have the points added then they can revoke your licence without telling you. There is no point in fighting it as you will more than likely lose or lose a lot of money trying. Also some convictions the points are applicable from the date of the incident as they were in your friends case therefore he got six points within his first two years and in some other cases the points are applicable from the date of conviction such as DR10 or IN10 (drink driving or driving without insurance)

that's unlucky, but it's all pukka i'm afraid. You'll have to plead with them saying that you need your wheels to make a living. They'll prob hit you with a massive fan but let you keep the license

On a more serious note though, as they have already revoked the licence I am afraid your mate can probably do no more than retake his test to get his licence back.

i dont get it, if nobody else was involved and nothing was damaged(hedge hardly counts) they dont give you any points? i had exactly the same sort of accident not long after i passed my test and i'v never heard anything or got any points or the ilke? cops were called and i got towed ect... you cant be telling the whole truth about the accident.
