    Accident help and reassurance.

    Where do i start Had an accident today and was just hoping on some opinions to put my mind at ease.

    Basically i was heading down a main A road at 40mph (the limit) following traffic (leaving a safe gap in front doing nothing wrong) and some guy pulls out infront of me trying to cut accross my lane and join the traffic on the other side. So basically i slam on the brakes and try to swerve but...... BUMB i hit him at about 10mph-ish.

    Now theres not much damage but it'll need repairing through the insurance and wot not but i just wanna check that theres no chance of me being held responsible? or it even being 50/50 as i dont wanna loose my no claims

    Am i correct in thinking its the person who is pulling out of the junction responsibility to check its clear and safe to do so. And thus making him responsible? I just want some opinions as im worring now because the guy wouldn't admit it was his fault at the time

    Any opinions welcome, just wanna know if theres any chance ill be held responsible which i cant see how!? or any chance of 50/50?

    You should be fine. Those double dashed lines (diag 1003 from the traffic regs) means do not pull out in any way to cause a vehicle approaching from the right to change speed or direction to avoid a collision.

    Make sure you let the insurers have the pics too.

    Ill definitely be sending the pics to the insurance company along with that extract from the traffic reg's although im sure they'll be aware of that theres no harm in sending it anyway.

    You hit another bloody astra

    Thats hit tho greg, even worse when its not your fault and they denie its theirs!

    How they could think that is anyones but their own fault i dont know, they pulled out into flowing traffic.

    Hope you get t all sorted though mate.

    I know had to be another astra didnt it Still id rather that than a volvo or something lol.

    Glad you think the same way as me, i cant see how it could be mine or even 50/50 but i think his exact words were "well we're both in the wrong" and mine were "i wasnt in the bloody wrong"

    P.s was nice meeting you at PVS gutted i cant make Billing although i don't have a car to make it in now lol

    I don't know i didn't even bother to ask. But yea probably because i didn't manage to avoid his careless driving lol.

    Yea ill try and make it to a few meets when i can....... maybe ill get a VXR for a courtesy car that i can bring

    He pulled out on you.

    You were quietly driving along minding your own business, in a straight line, doing the speed limit.

    He will try to make it look your fault as your car is modified, so he will class you as a young, careless driver (which your not), & he drives a sensible, standard car.
    He will probably try to say your were speeding too.
    He looked, saw noone coming for half a mile, pulled out & suddenly, you were there.

    Nobody wants it to be their fault in an accident.

    But, looking at the pics, & your diagram, it is definately HIS fault.

    Good luck with the repairs & hope it don't take too long.
