    Damp Course - Guarentee

    Anybody work for a company the provides a damp course or know the ins and outs of it all.

    Basically we had a damp course done in 2003 which now need relooking at. I contacted the firm who have said that I need to provide the orginal plan and report, the guarentee and invoice. I can't find the plan or report so they want to charge me £55+VAT for 'new orginals' for them they to charge another £70+VAT to come and have a look (refunded if work is covered).

    Surely all I need is the guarentee and invoice with paid on it, why should i have to provide a copy of the plan. To say that I am non to happy is an understatement so I would welcome help or info

    I believe you get 10 years guarentee but it may vary from firm to firm.

    This is just me thinking aloud, but....

    If they did your damp course, that means they've got personal information about you on file (your name and address).

    This means that they're obliged to abide by the terms of the Data Protection Act.

    Which states, amongst other things, that you're entitled to demand a copy of all they've got on record about you under the terms of the Data Protection Act and while they're allowed to charge, they're only allowed to charge a "nominal" fee (generally around £10). You'd have to speak to a solicitor or Citizens Advice, though, and there are probably easier ways to get them to do the work. Bearing in mind that I can't see it doing much good, as the company which decides whether or not the problem you've got is covered under the warranty stands to lose money if it is so it's in their interests to find some reason - however pathetic - to say "Ah, not our problem - we can fix it but it will cost you".

    they will have paperwork on you, well i hope so. invoices i recieve, by law i have to keep them for 7 years!

    problem sorted, after calling them they said that I DIDN'T have to provide the plan and assessment!! It clearly states in this complaint letter that I did so is obviously a tactic not to persue a claim under the 25yr guarentee!
