    Driving Home From M1...

    Got up early to go Alton Towers for a laugh with my girlfriend and mates. A few of us drove up and it was a great day apart from the weather.

    So we decide to leave after going on everything and I am 30 minutes away from home on the M1 and am in the fast lane and I indicate to go ino the middle lane and look into my mirrors...

    No car there at all and then suddenly this bloke in a Merc thought he was flashy by trying to UNDER PASS me and drives straight into the side of my car!!!

    Wheel arch, passenger door strached and dented. Side skirt basically falling off! The passenger door does not even open!

    The flashy idiot looked at me and smurked at me as to say "it's your fault", I was so angry. So we had to ring the police and I asked him "where do you live?" He told me Dublin but then he gave me an address in London, he was foreign but seemed to me like he was lieing!

    So it is going through insurances to see who's fault it actually was but Im going to fight this to the death! There is only one problem though... I have 3 points but did not declare it on my insurance as I was told you only need to tell them when you renew it!!! So I am pretty worried! Have I got anything to worry about?

    Does anyone have a rough idea of the damage caused to my car and the cost of it? I will try and get some pictures!

    unlucky mate.

    you do see people under-taking alot on the motorway.

    I dont know about the points, but i think they will look into it.

    Would need to see pics to asses the damage.

    Andy I jus couldn't believe it. We had a good day and the day was jus ruined basically! Also the worst thing was he was so arrogant... the police were on the phone to me and asked to put the other driver on the phone. So I got out and gave him my phone... he basically snatched it off me and done his window up! I just wanted to drag him out of the car but that would basically be me finished!

    Please tell us when you renew your insurance
    of any motoring convictions or fixed penalties you had during the year, or any pending prosecutions.

    So, you should be fine mate.

    Yes, probably.

    Depends on how your insurance company want to view it but they are essentially within their rights to void your insurance policy and refuse to pay any claim due to non disclosure.

    Unlucky on the accident though, merc driver sounds like an arse.

    sorry to hear about the car mate, sounds like the other guy could be either using a faulse name and address or something like that from what you have said. hope it get sorted soon mate

    Thanx guys, much appriciated and I hope I can get through this. I have a quote from my Vauxhall garage where I bought the car coming through tomorrow morning.

    I'll keep you up to date as events go on.

    My lawyer has checked the Merc he was driving and it is insured. You expect a 52 plate Merc to be insured anyway! I just hope the 3 points doesn't make the insurance company make their mind up even though it was not my fault.

    hate to say it but i think the best you could hope for is 50/50

    from the sounds of it you hit him as you moved lane (correct me if i'm wrong), which afaik in the eyes of the law makes it your fault as you were the one changing lanes (unless you can somehow prove he was undertaking).


    as for the points, check your policy details as Gaz has pointed out there may be writing saying that it needs to be declared at next renewal which would put you in the clear. Conversely it may require immediate disclosure, in which case you may have a problem, but either way you'll know if you check the documents!
